Terms of Use

 1.  These Terms of Use, which are set out in detail below, govern the use of this Web Portal and all applications, software components, and services (collectively, ‘Services’) available on the Web Portal, except in cases where such Services are the subject of a separate agreement.

 2.  The use of the Web Portal constitutes irrebuttable evidence that both the simple visitor and the registered user have studied, understood, and fully accepted all the terms of use of the Web Portal, as well as the terms of the privacy policy, in accordance with applicable Legislation. In the event that the visitor/user does not agree with the terms of use herein, they must refrain from using the services and content of the Web Portal. In any other case, absolute understanding of the terms, full acceptance thereof, and indisputable agreement with them is presumed.

 3. These terms of use may be revised/modified/updated at any time and without notice. The user/visitor must periodically check the terms of use of the Web Portal. Use of the Web Portal constitutes irrebuttable evidence that both the simple visitor and the registered user have been informed of any revisions/modifications/changes.

 4. Product names and corporate titles used on the Web Portal are registered trademarks protected under Greek and European Legislation. Any reproduction, partial or total, or use there of without the express written permission and consent of the Company is strictly prohibited. All content of this Web Portal, which indicatively and not restrictively includes software, texts, graphics, images, photographs, designs, video, sounds, etc. (hereinafter “Content”), constitutes the intellectual property of HWB and is protected by applicable national, community, and international law. HWB reserves all intellectual, related, and industrial property rights regarding the content and the copies created based on it.

 5. HWB grants the visitor/user a limited, personal, non-transferable, non-sublicensable, and revocable license to access and use only this Web Portal, as well as its content and information. Similarly, HWB grants the visitor/user a limited, personal, non-transferable, non-sublicensable, and revocable license to access and use the software, computer, and network services for the completion of their registration/activation of the HWB card, only in the manner expressly permitted by HWB. With the exception of this limited license, HWB does not transfer any other rights over its systems, information, data, software, or any other property element of HWB.

 6. The official price list of HWB applies to every user/visitor and is effective at the time of connection and submission of the request for the activation of the HWB card. The relevant activation is governed entirely by these Terms of Use, in addition to all other terms and conditions that may apply to said transaction, as contained herein and in any potential Service Agreement(s). By this provision, the official price list of HWB is incorporated into these Terms of Use, so that any reference to the Terms of Use contained herein is deemed to include, to the extent applicable, both the official price list and all additional terms and conditions that may apply to the transaction in question.

 7. The Fair Use Policy as well as the Privacy Policy of HWB govern the use of information collected or provided by each user/visitor of the Web Portal. Regarding any user/visitor whose personal data is provided to HWB, they (the user/visitor) declare to HWB that they have obtained all necessary consents for the processing of said personal data, as provided for by the Services they use and by HWB’s Privacy Policy; this includes consent for the transfer of said data to any official Authority or Service that may request them following the observance of legal procedures, even if it concerns a Service or Authority of a third country whose laws may not provide the same level of personal data protection as the laws applicable in the individual’s country.

 8. All information provided or completed by the visitor/user for the fulfillment of their request is considered confidential and is transferred only to the directly interested party and to the competent Authority or Authorities or Services as per the law, in the event that the use by the visitor/user contravenes the Terms of Use of HWB and, in general, the applicable Greek legislation. Specifically, the latter may be deemed appropriate when the use of this Web Portal by a visitor-user violates its operating rules. In such a case, all information of said visitor-user, as well as their IP address, may be part of any investigation, should this be required for the protection of HWB’s rights.

 9. In addition to other restrictions set forth in these Terms of Use, each visitor/user expressly agrees that they:

In the event that data is sent to the Web Portal, it must not contravene Greek legislation and morality regarding internet use in general, nor must it be altered by the visitor-user performing the publication or knowingly by others. This data may be used by HWB without any claim against it by the visitor-user providing it. Every visitor-user is responsible for the use of this Web Portal and may use its services only for legal and legitimate purposes.

 11. Each visitor/user, if they so wish, submits their details and creates one and only one account. Every visitor/user is prohibited from creating false accounts with fraudulent or non-fraudulent intent, or from collecting or storing the personal data of other users in any way. HWB reserves the right to seek satisfaction for any damage resulting from the violation of the above prohibitions by the visitor/user and to take any relevant legal action, proceeding, and legal corrective out-of-court or judicial measures aimed at preventing the violation of these terms of use.

 12. Our services are provided free of charge to HWB’s customers. Any costs for potential medical services required to be provided to certified users by the cooperating medical centers, private clinics, or polyclinics, cooperating physicians, etc., with all of whom HWB has signed a cooperation agreement that is in force and has not been revoked/cancelled/modified—and which are included in the specific section of the Web Portal, freely and fully accessible by all registered users—shall be borne exclusively by the users. The users alone bear the relevant responsibility toward the cooperating physicians, with HWB having absolutely no involvement or liability, a fact which is expressly recognized by all users without exception.

 13. The Web Portal may contain links to third-party websites and resources. These linked sites are provided solely for the convenience of users/visitors and not as sites whose content bears the endorsement of HWB. HWB makes no promises or warranties regarding the correctness, accuracy, performance, or quality of any content, software, service, or application found on any such linked third-party site. It is understood that HWB is not responsible for the availability of these sites or the content or activities thereof. If you decide to access linked sites, you do so at your own risk and responsibility. Furthermore, the use of linked sites is subject to the applicable policies, terms, and conditions, including, but not limited to, the privacy policy and fair use policy of the linked site.

 14. Under no circumstances should the user/visitor rely on the information that may be displayed on this Web Portal as a substitute for medical advice and treatment, nor does such information replace in any way professional medical advice, examination, diagnosis, and treatment, to which the user/visitor must resort without delay upon the discovery or suspicion of a medical problem. In the event that the user/visitor faces a medical emergency, as understood by common experience, they must immediately call the telephone number 166 within the Greek Territory or the Pan-European Emergency Number 112. If located in a third country—outside of Greece—the three-digit, four-digit, or five-digit emergency medical assistance number may vary.

 15. The use of information and presentations on the Web Portal is carried out at the sole responsibility of the visitor/user; HWB bears no responsibility for any delays, failures, interruptions, or corruption of any data or information related to its website. The visitor/user is considered exclusively responsible for access to their personal accounts maintained with HWB, as well as for securing their access codes from unauthorized persons. They are solely responsible for the control, use, management, and access of activation codes as well as access passwords.

 16. No information obtained by the visitor/user from HWB and its services shall create any warranty or obligation on its part, unless such has been expressly provided for in these terms of use.

 17. HWB undertakes the obligation, should errors be pointed out by the visitor/user, to make every effort to correct them as soon as possible. Nevertheless, the visitor/user uses any data and material available and contained in this website at their sole responsibility; such data and material are provided without any guarantee whatsoever as to their correctness and accuracy, and HWB bears no responsibility, direct or indirect, for any damage (actual or consequential) that may occur to anyone from the use of its website or the elements contained therein. At any time and without notice to the users, HWB may carry out changes and improvements that, in its judgment, will facilitate the operation of the Web Portal.

 18. The visitor/user accepts the keeping and processing of their personal data, as declared by them. HWB is entitled to disclose such data to third parties cooperating with it for the sole purpose of the proper and effective operation and provision of HWB’s services. Furthermore, the administrator(s) of the web portal shall maintain a file with the personal data of users/visitors, in accordance with the terms and conditions of Law 2472/1997 as currently in force, regarding the confidentiality of personal data, being obliged to comply with the provisions of Law 2225/1994 and Presidential Decree 47/2005 for the waiver of such confidentiality before any judicial authority, for reasons of national security or for the investigation of particularly serious offenses and for any reason specified by law, following the procedure provided by law.

 19. HWB recognizes and accepts, pursuant to Articles 4 and 4a of Law 2251/1994 on distance contracts, that the registered user/user has the right to withdraw from the transaction without giving any reason within fourteen (14) days from the date of their card activation, provided they have not previously used it. To exercise the right of withdrawal, the registered user/user must inform HWB of their decision by means of a statement, which shall be sent to HWB by any appropriate means (email with a request for a read receipt, registered letter, fax with confirmation of transmission and receipt, etc.). The statement must be explicit and clear, containing no terms, conditions, or deadlines, and its effects shall commence upon its proven receipt by HWB. In this case, HWB shall refund the amount paid by the registered user/user (excluding costs resulting from the registered user’s/user’s choice of a refund method other than the least expensive standard delivery method offered by HWB) within thirty (30) days, without undue delay.

 20. The visitor/user expressly accepts that the exclusive jurisdiction and competence for any dispute that may arise with HWB shall belong to the Courts of Thessaloniki, Greece, and the applicable law shall be Greek law in all cases, even when access to the Web Portal is made from a country outside of Greece. If any of the above terms is deemed invalid by a court decision, this shall not affect the validity and enforceability of the remaining terms, which shall remain in full force and effect. The invalid term, as and when it is deemed such by a competent Judicial Authority, shall be immediately replaced by a valid term with content that interprets the meaning of the provision deemed invalid.

 21. The use of the HWB website, all its services, and its content are subject to the aforementioned terms of use. If the visitor-user considers these terms unacceptable for any reason, they are requested to refrain from using the HWB website. The use of the HWB website by the visitor constitutes full acceptance, consent, compliance, approval, and agreement on behalf of the user regarding all present terms of use and the terms of the privacy policy.

It is expressly agreed that the use of this Web Portal automatically entails the acceptance of the terms as they currently apply and are adjusted from time to time by the website administrators.
